1. Acceptance of Terms

By accessing or using SMARKAFRICA, you agree to be bound by these Terms & Conditions. If you do not agree, please refrain from using the platform.

2. Definitions

• "Platform" refers to SMARKAFRICA (smarkafrica.africa).
• "Buyer" refers to any user purchasing products on the platform.
• "Seller/Admin" refers to the platform operator.
• "Digital Products" include PDFs, eBooks, software, audio files, and other downloadable content.
• "Physical Products" are tangible goods shipped to the buyer's address.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. All activities under your account are your responsibility.

4. Payments

All payments are processed exclusively through M-Pesa STK Push. Payment is required before digital product delivery or physical product shipment.

5. Digital Products

• Digital products are available for immediate download after payment confirmation.
• Due to the nature of digital goods, all sales are final unless the product is defective or corrupted.
• Buyers may download purchased files up to 3 times within 30 days of purchase.

6. Physical Products & Shipping

• Shipping costs are calculated based on weight and destination.
• Estimated delivery times vary by location.
• Risk of loss passes to the buyer upon delivery to the shipping carrier.

7. Refunds & Returns

• Digital products: No refunds after download, except for technical defects.
• Physical products: Returns accepted within 7 days of delivery for defective or incorrect items.
• Refunds are processed within 3-5 business days via M-Pesa.

8. Prohibited Activities

Users may not: distribute copyrighted content without authorization, attempt to hack or breach platform security, engage in fraudulent transactions, or harass other users.

9. Limitation of Liability

SMARKAFRICA is provided "as is." The platform operator shall not be liable for any indirect, incidental, or consequential damages.

10. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes via email.
